US Judge Orders Freedom of Abrego Garcia from Immigration Custody
A court has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without lawful basis.
"Since his release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.
The case stems from a mistaken removal to El Salvador in March, which the government later acknowledged was an error. Following his return to the United States to face human smuggling charges, he was held in federal custody.
In her order, the judge noted that the government lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
Context of the Legal Challenge
The court proceedings center on disputed assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in the state of Tennessee.
Conditions of Release
The court, who was overseeing his challenge to removal in a federal court, determined that he must now comply with the terms of his release from jail in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.
This decision represents a significant development in a complex immigration battle involving allegations of wrongful detention and contested gang associations.
